These Terms of Service ("Terms") govern your use of the training services and website operated by Brickfield Systems B.V. By accessing our website or purchasing our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Scope
These Terms apply to all training services, website usage, free trials, and related materials provided by Brickfield Systems B.V. ("we", "us", "our"), a company registered under the laws of the Netherlands as a Besloten Vennootschap (B.V.), with registered office at Herengracht 420, 1017 BZ Amsterdam, Netherlands. KvK number: 82941753. BTW-nummer: NL862491738B01.
These Terms apply to individual participants, corporate clients, and any person accessing our platform.
2. Service Description
Brickfield Systems provides professional development training focused on infrastructure operations. Our services consist of online training courses, hands-on lab environments, reference materials, and completion certificates. We are a training provider — we do not provide software, managed services, or IT consulting.
Our training covers configuration management, monitoring pipelines, incident response workflows, multi-tenant management, capacity planning, and related infrastructure topics. Networking, database administration, and application development are outside our scope.
3. User Obligations
By using our services, you agree to:
- Provide accurate and complete information when creating an account or signing up for a trial.
- Keep your login credentials confidential and not share your account with others.
- Use the training materials and lab environments solely for your own professional development or the development of your team, as permitted by your plan.
- Not reproduce, distribute, or publicly display any of our course materials without written permission.
- Not attempt to disrupt, overload, or gain unauthorised access to our platform or systems.
- Comply with all applicable laws and regulations while using our services.
4. Intellectual Property
All course content, training materials, lab configurations, branding, website design, and other intellectual property on our platform are owned by Brickfield Systems B.V. or licensed to us. You may not copy, modify, distribute, sell, or create derivative works from our materials without our prior written consent.
Your purchase or trial grants you a limited, non-exclusive, non-transferable right to access and use the course materials for the duration specified in your plan. This licence terminates when your access period expires or when your account is terminated.
5. Payment
All prices are quoted in Euros (EUR). Current pricing for our standard plans is as follows:
- Starter: €1,400 per seat — single track access.
- Professional: €2,900 per seat — full platform access.
- Enterprise: Custom pricing — contact us for a quote.
For corporate clients, we issue invoices with NET 30 payment terms from the invoice date. VAT (BTW) is applied in accordance with Dutch and EU regulations. Late payments may incur statutory interest as permitted under Dutch law.
We reserve the right to adjust pricing. Any price changes will not affect existing confirmed orders or active subscriptions.
6. Free Trial
We offer a 14-day free trial that provides full access to one training track. The trial requires no credit card or payment information to start. There is no automatic billing when the trial period ends. We send a reminder email on day 12 of the trial to inform you that your trial is nearing completion.
At the end of the trial, your access to the course materials will expire. To continue, you may purchase a paid plan. We will not charge you unless you explicitly choose to purchase a plan and complete the payment process.
7. Right of Withdrawal and Refunds
In accordance with Dutch distance selling regulations (Wet Koop op Afstand), consumers purchasing services at a distance have the right to withdraw from the contract within 14 calendar days of the purchase date without giving any reason. To exercise this right, you must notify us by email at info@brickfieldsystems.nl with a clear statement of your decision to withdraw.
If you have not accessed any course content during the withdrawal period, we will issue a full refund within 14 days of receiving your withdrawal notice. If you have begun accessing course content and explicitly consented to the commencement of the service during the withdrawal period, you acknowledge that you may lose part or all of your right of withdrawal, in accordance with Article 6:230p of the Dutch Civil Code.
For corporate clients with custom invoicing arrangements, refund terms will be specified in the applicable service agreement.
8. Limitation of Liability
To the maximum extent permitted by Dutch law, Brickfield Systems B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to loss of revenue, data, or business opportunities.
Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms excludes or limits our liability for fraud, wilful misconduct, or any other liability that cannot be excluded under Dutch law.
9. Warranty Disclaimer
Our training services and materials are provided "as is" and "as available." While we make reasonable efforts to ensure the accuracy and quality of our content, we do not warrant that our services will be uninterrupted, error-free, or free of all inaccuracies. We do not guarantee specific outcomes or results from completing our training programmes. Professional decisions should not be based solely on the content of our courses.
10. Termination
We may suspend or terminate your access to our services if you breach these Terms, fail to pay invoiced amounts within the agreed timeframe, or engage in conduct that we reasonably determine to be harmful to other users or our platform. Where possible, we will provide notice before termination and an opportunity to remedy any breach.
You may terminate your account at any time by contacting us at info@brickfieldsystems.nl. Termination does not entitle you to a refund of fees already paid, except as provided under the right of withdrawal in Section 7.
11. Data Protection
We process personal data in accordance with the General Data Protection Regulation (GDPR/AVG) and our Privacy Policy. By using our services, you acknowledge that you have read and understood our Privacy Policy. Where we process data on behalf of a corporate client (e.g., employee training records), we act as a data processor and will enter into a data processing agreement upon request.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any legal proceedings arising from or related to these Terms shall be brought exclusively before the competent courts of Amsterdam, Netherlands.
13. Dispute Resolution
In the event of a dispute arising from these Terms or our services, the parties agree to first attempt to resolve the matter through good-faith mediation. If the dispute cannot be resolved through mediation within 60 days, either party may bring proceedings before the competent courts of Amsterdam, Netherlands.
This clause does not affect your statutory rights as a consumer under Dutch or EU law, including your right to bring proceedings in the courts of your place of residence.
